ForgeIQ Premium Membership Terms of Use

Welcome to ForgeIQ Premium. By subscribing to and participating in ForgeIQ Premium services, including direct consultations and personalized recommendations, you agree to the following Terms of Use. Please read this agreement carefully. If you do not agree with these terms, do not use or subscribe to ForgeIQ Premium.

Informational Purposes Only – No Medical Advice

All content, communications, and consultations provided through ForgeIQ Premium are for informational and educational purposes only and are not intended to substitute professional medical advice, diagnosis, or treatment.

Although consultations may be conducted by a licensed physician, no formal physician-patient relationship is established through the use of ForgeIQ, and any guidance offered should not be construed as medical advice. You should not rely on any information provided through ForgeIQ Premium as a substitute for professional healthcare judgment.

No Physician-Patient Relationship

• No formal physician-patient relationship is created through your subscription or any communications with the ForgeIQ team.
• No medical treatment, diagnosis, or prescription is provided.
• ForgeIQ does not maintain any obligation to provide medical care, follow-up, or emergency services.

Voluntary Participation and Assumption of Risk

• You acknowledge that participation in fitness, diet, supplementation, and wellness programs involves inherent risks, including but not limited to physical injury, illness, or death.
• You voluntarily assume full responsibility for any risks, injuries, or damages that may result.
• You agree that ForgeIQ, LLC and its representatives shall not be held liable for any claims, damages, losses, or injuries resulting from your use of the service.

Limitation of Liability and Indemnification

• To the fullest extent permitted by law, ForgeIQ, LLC and its affiliates, officers, agents, employees, and contractors shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to your use of the Premium service.
• You agree to indemnify and hold harmless ForgeIQ, LLC from and against any claims, losses, liabilities, damages, costs, or expenses (including attorney's fees) arising from your use of the service, your breach of this agreement, or any violation of law.

Eligibility and Medical Readiness

• You are at least 18 years of age.
• You are in good general health and physically able to engage in fitness and nutritional programs.
• You are not aware of any medical condition that would make participation unsafe or inappropriate without prior medical approval.
• Users with chronic medical conditions (including but not limited to cardiovascular, metabolic, endocrine, or orthopedic conditions) must obtain clearance from their licensed healthcare provider before subscribing or acting upon ForgeIQ recommendations.

Intellectual Property

All content, code, documentation, designs, videos, and recommendations provided within ForgeIQ Premium are proprietary to ForgeIQ, LLC and may not be copied, distributed, republished, or otherwise used for commercial purposes without prior written consent.

Modification of Terms

ForgeIQ, LLC reserves the right to modify these Terms of Use at any time. If changes are made, users will be notified via the platform or email. Continued use of ForgeIQ Premium constitutes acceptance of the revised terms.

Governing Law and Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Any dispute arising under these terms shall be resolved exclusively in the state or federal courts located in Florida.

Severability

If any provision of this agreement is found to be unlawful, void, or unenforceable for any reason, that provision shall be deemed severable from the remaining provisions and shall not affect their validity or enforceability.

1. Eligibility

You must be at least 18 years old to use ForgeIQ. By using the Service, you represent and warrant that you (a) are 18 years of age or older, (b) have the legal capacity to enter into these Terms, and (c) will comply with all applicable laws.

2. Subscription & Access

Access to certain features of ForgeIQ, including AI-driven coaching, physique analysis, and anabolic consultation tools, requires a paid subscription. When you register for an account or subscribe, you agree to provide accurate and complete information and keep it updated.

You are responsible for:

• Maintaining the confidentiality of your login credentials;
• All activities that occur under your account;
• Not sharing account access with others.

3. Intellectual Property Rights

3.1. Ownership

All content, software, source code, designs, interfaces, branding, graphics, logos, and functionalities on ForgeIQ are the exclusive intellectual property of ForgeIQ LLC or its licensors and are protected under U.S. and international copyright, trademark, and patent laws.

This includes:

• AI-generated training and nutrition plans
• Dynamic physique feedback systems
• User dashboard designs
• Original illustrations and training animations
• The ForgeIQ name, flame logo, and tagline: "BUILT DIFFERENT. BUILT SMARTER."

3.2. Limited License

We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own fitness or health tracking purposes. You may not:

• Modify, reverse engineer, or create derivative works from any portion of ForgeIQ;
• Use content or code from ForgeIQ to build a competitive product;
• Resell, license, or commercially exploit any portion of ForgeIQ without our written permission.

3.3. User Feedback

If you provide suggestions, feature ideas, bug reports, or other feedback to ForgeIQ, you agree that we may use such input freely and without restriction, without compensating you.

4. User Content and Conduct

4.1. User Data

You retain ownership of all personal data you upload, including biometric stats, photos, and inputted workouts. By using the Service, you grant us permission to analyze this content to provide coaching and progress-tracking insights.

4.2. Prohibited Content

You may not upload or share:

• False or misleading health data;
• Copyrighted content you don't own;
• Inappropriate or sexually explicit images;
• Content that violates any law or infringes on the rights of others.

We reserve the right to remove any content or suspend accounts that violate these standards.

5. AI-Powered Services

ForgeIQ includes AI-generated recommendations for fitness, nutrition, and physique coaching. These are not medical advice. For discussions about hormone optimization or anabolics, access is restricted and subject to professional review under our medical partners.

By using ForgeIQ, you acknowledge:

• The coaching content is educational and should be interpreted as general wellness advice;
• You are responsible for consulting a qualified healthcare provider before implementing any training, nutrition, or supplementation recommendations.

6. Termination

We reserve the right to suspend or terminate your account without notice if:

• You breach these Terms;
• You misuse or attempt to reproduce ForgeIQ's proprietary tools;
• You fail to pay for a subscription;
• Your behavior threatens the integrity or functionality of our platform.

Upon termination, all licenses granted to you under these Terms will immediately cease.

7. Payments, Renewals & Refunds

• Subscriptions auto-renew unless cancelled before the billing date.
• Prices are subject to change, but we'll notify you in advance.
• All subscriptions and services are non-refundable.
• All monthly subscriptions are billed monthly.
• All annual subscriptions are billed annually.
• All subscriptions are billed in US dollars.
• All subscriptions are billed to the credit card on file.

8. Limitation of Liability

To the fullest extent permitted by law, ForgeIQ LLC shall not be liable for any indirect, incidental, special, or consequential damages, including health outcomes, injury, or loss of data, arising out of your use of the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available." We make no guarantees about:

• Fitness results or transformation outcomes;
• Availability or uptime of our services;
• Compatibility with all devices or operating systems.

10. Indemnification

You agree to indemnify and hold ForgeIQ, its officers, partners, and employees harmless from any claims, losses, or liabilities arising out of your use of the Service, including misuse of AI recommendations or unauthorized distribution of our IP.

11. Modifications to These Terms

We may update these Terms from time to time. You will be notified of significant changes, and continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. You agree to the exclusive jurisdiction of courts located in Miami-Dade County, Florida.
